Can One Swear By the Quran By Placing One’s Hand Over It?

Question: 

Is it permissible to touch the Mushaf and say you swear you did or did not do such and such?

Answer:

Walaikum assalam,

I hope you’re doing well, insha’Allah.

Swearing an oath needs to be by Allah Most High or His Names. [Quduri, Mukhtasar; Nasafi, Kanz]

If one places one’s hand over the copy of the Quran for emphasis, this is fine. This is not from the practice of the Prophet (peace and blessings be upon him) or the early generations (salaf)–but a lot of scholars from the earliest centuries permitted it for emphasis. [Shirbini, Mughni al-Muhtaj; others]

However, in the Hanafi school, it isn’t sufficient simply to swear by the Quran, even if it becomes customary–unless one swears by Allah, as explained. [Ibn Abidin, Radd al-Muhtar]

And Allah is the giver of success and facilitation.
